Terms of service

These Terms of Service ("Terms") govern your use of **pumpkins.pet** (the "Site") and purchases from **Pumpkins Pet LLC**, a Utah limited liability company doing business as Pumpkin's ("Pumpkin's," "we," "us"). By using the Site or placing an order, you agree to these Terms. If you don't agree, please don't use the Site.
### 1. Who can buy
You must be at least 18 years old, or the age of majority where you live, to place an order, or use the Site with the involvement of a parent or guardian. We sell only to customers with US shipping addresses.
### 2. Our product
Gut Magic is a single-ingredient organic pumpkin **food topper for cats**. **It is food, not a medication.** It isn't intended to diagnose, treat, cure or prevent any disease. Content on the Site, including articles and guides, is for general information only and isn't veterinary advice. Always talk to your veterinarian before changing your cat's diet, especially if your cat is a kitten, is pregnant or nursing, has a health condition, or is on a prescription diet. If your cat shows signs of illness, such as straining, no stool for 2+ days, blood or repeated vomiting, contact your veterinarian right away.
Follow the feeding directions on the package. We aren't responsible for results from using the product differently than directed.
### 3. Orders and pricing
- Placing an order is an offer to buy. We accept your order when it ships. Until then, we may decline or cancel it, for example if an item is unavailable, a price or description was wrong, or the order looks fraudulent. If we cancel, we'll refund you in full.
- We work to keep prices, descriptions and images accurate, but errors happen. We may correct errors at any time, including after an order is placed.
- Prices are in US dollars and don't include applicable sales tax, which is calculated at checkout.
- All purchases are one-time purchases. We don't offer subscriptions or recurring billing.
### 4. Payment
You agree to give accurate payment information and that you're authorized to use your payment method. Payments are processed by Shopify and its payment partners under their terms.
### 5. Shipping, risk of loss and title
Shipping is covered by our Shipping Policy. Title and risk of loss pass to you when your order is delivered to the shipping address you gave us.
### 6. Guarantee, refunds and cancellations
Our 90-day money-back guarantee, refunds and cancellations are covered by our Refund & Return Policy and Purchase Options & Cancellation Policy, which are part of these Terms.
### 7. Reviews and content you send us
If you send us reviews, photos, comments or other content, you confirm it's yours to share and it's truthful. You give us a non-exclusive, royalty-free, worldwide license to use, reproduce and display it in connection with Pumpkin's, including on the Site and in marketing. We won't edit your review in a way that changes its meaning. We may decline to post or may remove any content.
### 8. Acceptable use
Don't misuse the Site. Specifically, don't:
- break any law
- interfere with the Site's security or operation
- scrape it or access it with bots, except search engines
- impersonate anyone
- place orders for resale without our written permission
- post false, abusive or infringing content
### 9. Intellectual property
The Site and its content belong to Pumpkins Pet LLC or its licensors and are protected by intellectual property laws. This includes the Pumpkin's and Gut Magic names, logos, packaging, text, photos, videos and design. You may view and share Site pages for personal, non-commercial use. Any other use requires our written permission.
### 10. Third-party links and services
The Site may link to third-party websites, such as research articles, and uses third-party services, such as Shopify for checkout. We don't control and aren't responsible for third-party content, products or practices.
### 11. Disclaimer
Except for our express 90-day money-back guarantee and as required by law, the Site and products are provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all other warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Every cat is different, and we don't promise any particular result.
### 12. Limitation of liability
To the fullest extent allowed by law, Pumpkin's and its members, employees and suppliers won't be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site or products. Our total liability for any claim related to an order is limited to the amount you paid for that order. Some states don't allow these limitations, so they may not fully apply to you. Nothing in these Terms limits liability that can't be limited by law.
### 13. Indemnification
You agree to indemnify and hold Pumpkin's harmless from claims, losses and expenses, including reasonable attorneys' fees, arising from your violation of these Terms or misuse of the Site.
### 14. Resolving disputes
**Talk to us first.** If you have a problem, email **parker@pumpkins.pet** and give us 30 days to try to make it right. Most issues are solved with one email.
If we can't resolve it informally, these Terms are governed by the laws of the **State of Utah**, without regard to conflict-of-law rules. Either of us may bring a claim in small claims court if it qualifies. Otherwise, any claim must be brought in the state or federal courts located in **Utah County, Utah**, and you and we consent to their jurisdiction. Nothing here limits rights you have under consumer-protection laws of the state where you live that can't be waived.
### 15. Changes
We may update these Terms from time to time. The "Last updated" date shows when they last changed. Changes apply to orders placed after the update.
### 16. Miscellaneous
If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision isn't a waiver. These Terms, together with the policies referenced above and our Privacy Policy, are the entire agreement between you and us about the Site and your purchases.
